DUI: KNOW YOUR RIGHTS

Image
By:  Joe Cronk   Any vehicle stop has the potential to become a DUI investigation, even if you’re not guilty!  It’s important that you know your rights.  Georgia Law does not state that driving with any alcohol in your system is illegal, only that the State must prove you are an impaired driver because of alcohol, or that your per se blood alcohol concentration is .08 or higher.  In order to determine your blood alcohol concentration, the State will need either a breath test, or a blood test. You have a Constitutional Right to deny all testing.  You read that correctly.  You have a total right to deny any and all field sobriety tests, and any breath or alcohol tests.  There is the possibility of a one year license suspension for refusing a blood or breath test, but this suspension is NOT absolute. Blood and breath tests are not always accurate.  Remember your rights when you are stopped for DUI. If you are notsure you should be driving, use this test first http://www.alcoholhelpcent

A car accident is a stressful time for everyone involved, but the time afterward is crucial. If at all possible, try to follow these simple easy steps to keep your car accident from becoming a disaster. Step One: Accurately and patiently let the officer know how the accident occurred. It is best to do this in as calm a manner as possible. Officers are people too and can sometimes make mistakes when flustered. If you are calm, the officer will remain calm too, and there is a better chance of him accurately documenting the facts. Step Two: Document your injuries, starting now! If you are injured in a car accident, it is important to let someone know immediately. Let the officer know, let your significant other know, and let your doctor know as soon as possible. If you feel like you need an ambulance, do not hesitate to accept the officer’s request to call emergency medical services. Step Three: Make sure you get the insurance information from the other driver, or that the Officer has d
